On what basis do we process Personal Data?

The processing of personal data requires the existence of a legal basis that legitimizes this processing.

Colaço & Martins Lda processes personal data based on at least one of the following grounds:

How long do we keep Personal Data?

The retention period of personal data varies according to the purpose for which they were collected. Whenever there is no specific legal requirement, the data will only be kept for the minimum period necessary for the purposes that motivated its collection and processing.

- The personal data of candidates in recruitment processes will be kept for a maximum period of 30 days in relation to the date of the interview, except in situations where collaboration with our company is effective (Real Estate Raising Contract or other), in which case the retention period will be the one to which the company is legally bound;

As mentioned, there are conservation periods for which there is a specific legal requirement. For example:

- The images captured by the video surveillance system are kept for a period of 30 days;

- The Law for the Prevention and Combat of Money Laundering and the Financing of Terrorism requires documentation to be kept for a period of 7 years;

 

Once the maximum retention period has been reached, personal data will be securely destroyed or processed for statistical purposes, anonymised, thus making it impossible to identify the holder. 

 

 

With whom do we share Personal Data?

Colaço & Martins Lda does not share personal data, except in the following situations:

- In the strict scope of real estate mediation, when such sharing/communications are necessary. Colaço & Martins Lda undertakes to use personal data exclusively under the terms of subparagraph b) of paragraph 1, article 6, of Regulation 679/2016 of the European Parliament and of the Council of 27 April 2016;

- To comply with the legal obligations to which it is subject, such as the obligations contemplated in the Law for the Prevention and Combat of Money Laundering and the Financing of Terrorism, and/or by court order;

- At the request of public or governmental authorities;

- When this is expressly requested by the data subject (Portability Law);

- For the declaration, exercise or defense of legally protected rights and interests of Colaço & Martins Lda, including in the context of judicial, arbitral, administrative or extrajudicial dispute resolution proceedings. The processing is based on the legitimate interest of Colaço & Martins Lda in protecting and defending its legally protected rights and interests, without prejudice to situations where processing is necessary for compliance with a legal obligation;
